Use of Web Site on these Conditions
Welcome to hotelroom.com! This agreement describes the legal framework in which you participate on hotelroom.com, what your rights and responsibilities are and what you can expect from us.
www.hotelroom.com ('the Site') is a website provided by Active Hotels Limited ('hotelroom.com', 'we', 'us', 'our'). All use of the Site and use of booking services is on the terms and conditions below. If you do not agree to these conditions cease use of the Site immediately.
This agreement and our privacy statement (which is part of this agreement) constitute the entire agreement, and supersede any other agreements or understandings (oral or written), between you and us with respect to their subject matters. You may print and keep a copy of these Terms. They are a legal agreement between you and hotelroom.com and can only be modified with our consent. We reserve the right to change the Terms at our discretion by changing them on the web site.
Making Bookings and Cancellations
We operate as a disclosed agent for third party suppliers (the hotels on our site). This means that the contract for the accommodation is between you and the supplier. In many cases this will mean that there are additional terms and conditions governing the contract as each supplier may have their own terms and conditions. Whilst we provide details of suppliers' policies these details are not intended to be a full list of the terms and conditions of any supplier.
When you make a booking a legally binding agreement is made when all your details have been entered and you click the "CONFIRM" button on the appropriate web page.
You undertake that the details you provide us with in making a booking are correct.
You can make cancellations either by contacting the supplier directly, or by going to the cancellation page shown at the bottom of your confirmation email. In the event that you use activehotels.com to cancel your booking we will inform the supplier of the cancellation within a reasonable time. Please be aware that the supplier may impose a cancellation charge depending on how far in advance of the booking you cancel. We do not accept liability for any cancellation charges incurred other than through our failure to notify a supplier within a reasonable time of receiving your notification to cancel.
Payment
In order to make a booking you must be over 18 years old and have the legal capacity to make the transaction. You undertake that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the transaction. You accept financial responsibility for all transactions made under your name or account. Our liability for our booking service is set out in the "Our Liability" paragraph below and otherwise in these Terms.
Accuracy of Information and Disclaimer
We do our best to ensure all information on the Site is accurate. If you find any inaccurate information on the Site let us know and we will correct it, where we agree, as soon as practicable. We make no representations that information is accurate and up to date or complete and accept no liability for any loss or damage caused by inaccurate information. This Site provides a large amount of information and there will inevitably be errors in it. We accept no liability and offer no warranties in relation to it and its content, to the fullest extent such liability can be excluded by law. Any views expressed in Hotel Reviews, Destination Guides or any other messages which are sent to us to be published on the Site ('Postings') by users of the site are not necessarily those of Active Hotels or anyone connected with it.
Intellectual Property on the Site
The Site contains copyright material, trade names and other proprietary information, including, but not limited to, text, software, photos, graphics and may in future include video, graphics, music and sound. The entire contents of the Site are protected by copyright law. We, or our licensors, own copyright and/or database right in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part except as provided in these Terms.
You may download information from the Site for your own personal use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without our express permission and that of the copyright owner. In the event of any permitted copying, redistribution or publication of copyright material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. You acknowledge that you do not acquire any ownership rights by downloading copyright material.
hotelroom.com and our logos on this site are our trade marks. You may not use those trade marks without our consent.
We provide hypertext links to other sites which are operated by other people. Using such a link means you are leaving our Site and we take no responsibility for, and give no warranties, guarantees or representations in respect of linked sites.
Rules of Posting
We encourage contributions to hotelroom.com ('the site') provided they are made in a responsible manner and for lawful purposes only. Only expressions of genuinely held belief or opinion of a person who has actually stayed at the hotel(s) in question may be posted. You accept all liability for the contents of all postings made by you or on your behalf.
We cannot review all transmissions by our users, however we reserve the right to monitor any information transmitted or received through our service. Comments posted on this site may at our discretion be removed, whether in breach of the Rules or not, without further explanation or notice to you. We reserve the right to identify you in response to a court order, threat of legal action or complaint.
If you see any comment on this site which breaches your or anyone else's rights or may be illegal, defamatory or otherwise should be removed, let us know immediately and we shall do our best to remove it as soon as possible pending investigation of the matter.
You must indemnify (pay) us for any losses we suffer if you breach this provision or any other provision of our Terms and Conditions or the Rules of Posting.
You may not use, or allow others to use, your Review Questionnaire to:
- Post any content that is abusive, vulgar, obscene, hateful, fraudulent, unlawful, threatening, harassing, or defamatory or which discloses private or personal matters concerning any person.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with anyone or entity.
- Post or transmit any advertising, promotional materials, or other forms of solicitation.
- Post or transmit any file that contains viruses, corrupted files, "Trojan Horses," or any other contaminating or destructive features that may damage someone else's computer.
- Post or transmit any material that you do not have a right to transmit under law (such as copyright, trade secret or securities) or under contractual or fiduciary relationships (as in non-disclosure agreements).
- Stray from the discussion topic.
Our Liability
We provide information on this Site free of any charge. The information provided on the Site is provided on the basis of no liability for the information given.
We do not accept any liability for the quality or type of services or goods provided by our third party suppliers (see Making Bookings), those whom we mention on our site or to whom we have linked our Site. It is for you to make your own judgment about the quality of such providers.
We are a distributor (and not a publisher) of content supplied by third parties of the Site. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, or users, are those of the authors or distributors and not of us. We do not necessarily endorse nor are we responsible for the accuracy or reliability of any opinion, advice or statement made on the Site.
The information on the Site does not constitute any form of advice or recommendation by us and is not intended to be relied upon by you in making (or refraining from making) any decisions.
In no event shall we be liable to you for any indirect or consequential loss, loss of profit, revenue or good will arising from your use of the Site or information on the Site. Subject as provided below, all terms implied by law are excluded to the fullest extent permitted by law.
By choosing to use hotelroom.com, you agree to indemnify hotelroom.com, its officers, agents, partners, and employees from any and all claims or damage, including reasonable lawyer's fees, made by third parties due to, or arising out of Content you choose to submit, post or transmit through hotelroom.com; or if your use of or connection to hotelroom.com; your violation of the User Agreement; or, your violation of any rights of another.
Our total liability to you is limited to the value of your booking.
We accept liability for death or personal injury caused by negligence or responsibility for fraudulent misrepresentation.
Barring from the Site
We reserve the right to bar users from the Site, on a permanent or temporary basis at our discretion. Any such user shall be notified and must not then attempt to use the Site under any other name or through any other user.
Third party suppliers
Because your contract is with the third party supplier any enquiries or complaints should be addressed to them. Their name, address and contact details will appear on the e-mail confirmation of the contract we send you.
Legal Jurisdiction and Law
English law shall apply to these Terms, notwithstanding the jurisdiction where you are based. You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms.
We make no warranty or guarantee that the Site or information available over it complies with laws other than those of England.
General
Any formal legal notices should be sent to us at the address at the end of these Terms by email confirmed by post.
Failure by us to enforce a right does not result in waiver of such right. You may not assign or transfer your rights under this agreement. We may amend these Terms at any time by posting a variation on the Site. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms.

www.hotelroom.com® is a website provided by Active Hotels Limited ("Priceline Europe", or "we"). This Agreement describes the terms and conditions applicable to the Name Your Own Price® ("NYOP") services available through the website ("Site"). This Agreement describes your responsibilities and, among other things, limits the liability of hotelroom.com®. BEFORE USING ANY OF THE NYOP SERVICES, PLEASE READ ALL OF THIS AGREEMENT CAREFULLY. BY ACCESSING ANY OF THE NYOP AREAS OF THIS SITE, USERS ("USERS" OR "YOU") AGREE TO BE LEGALLY BOUND AND TO ABIDE BY THESE TERMS AND CONDITIONS, WHICH WILL CONSTITUTE OUR AGREEMENT ("AGREEMENT"). If you do not agree with any part of this Agreement, YOU MUST NOT USE THE NYOP AREAS OF THE SITE. Priceline Europe reserves the right, in its sole discretion, to amend this Agreement at any time by posting the amended terms on this Site. The amended terms shall be effective from and after the date that they are posted on the Site. This Agreement may not otherwise be amended except in writing signed by both parties. Priceline Europe incorporates herein, by reference, its Privacy Policy.

General Terms and Conditions
Copyright Notice
You, the User, acknowledge that all content included on the NYOP areas of the Site, including the information, data, software, photographs, graphs, video, typefaces, graphics, music, sounds, images, illustrations, maps, designs, icons, written and other material and compilations (collectively, "Content") are intellectual property and copyrighted works of Priceline Europe and/or its third-party providers including, without limitation, the hotels and other travel suppliers that provide travel or other services through the NYOP areas of the Site ("Providers"). Reproduction or storage of information or works retrieved from the NYOP areas of the Site, in all forms, media and technologies now existing or hereafter developed, is subject to the U.S. Copyright Act of 1976, Title 17 of the United States Code.
Trademark Notice
"HotelRoom.com", "PRICELINE" and "NAME YOUR OWN PRICE" are registered service marks of priceline.com Incorporated. Other product and company names identified on the NYOP areas of the Site may be the name, trademark, trade name, service mark, logo, symbol or other proprietary designation of Priceline Europe or a third-party. The use on the NYOP areas of the Site of any name, trade name, trademark, service mark, logo, symbol or other proprietary designation or marking of or belonging to any third-party, and the availability of specific goods or services from such third-party through the NYOP areas of the Site, should not be construed as an endorsement or sponsorship of the NYOP areas of the Site by any such third-party, or the participation by such third-party in the offering of goods, services or information through the NYOP areas of the Site.
Acceptable Use
The NYOP areas of the Site are intended for personal, noncommercial use. The content and information on the NYOP areas of the Site (including, without limitation, price and availability of travel services), as well as the infrastructure used to provide such content and information, is proprietary to Priceline Europe or its suppliers and providers. Accordingly, as a condition of using the NYOP areas of the Site, you agree not to use the NYOP areas of the Site or its contents or information for any commercial or non-personal purpose (direct or indirect) or for any purpose that is unlawful or prohibited by this Agreement. While you may make limited copies of your travel itinerary (and related documents) for travel or services purchased through the NYOP areas of the Site, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from the NYOP areas of the Site. In addition, you agree not to:
i. access, monitor or copy any content or information of the NYOP areas of the Site using any robot, spider, scraper or other automated means or any manual process for any purpose without express written permission of Priceline Europe;
ii. violate the restrictions in any robot exclusion headers on the NYOP areas of the Site or bypass or circumvent other measures employed to prevent or limit access to the NYOP areas of the Site;
iii. take any action that imposes, or may impose, in the discretion of Priceline Europe, an unreasonable or disproportionately large load on the Priceline Europe infrastructure; or
iv. deep-link to any portion of the NYOP areas of the Site (including, without limitation, the purchase path for any travel services) for any purpose without express written permission of Priceline Europe.
You may only use the NYOP areas of the Site to make legitimate reservations, purchases or requests to purchase the products or services offered (each, a "Request") and shall not use the NYOP areas of the Site to make any speculative, false or fraudulent Requests or any Requests in anticipation of demand. You represent that you are of sufficient legal age to create binding legal obligations for any liability you may incur as a result of your use of the NYOP areas of the Site. You agree to promptly update your membership information (if applicable) in order to keep it current, complete and accurate. It is a violation of law to place a Request in a false name or with an invalid debit or credit card. Please be aware that even if you do not give us your real name, your web browser transmits a unique Internet address to us that can be used by law enforcement officials to identify you. Fraudulent users will be prosecuted to the fullest extent of the law.
Privacy Policy
You confirm that you have read our Privacy Policy, the terms of which are incorporated herein, and agree that the terms of such policy are reasonable and satisfactory to you. You consent to the use of your personal information by Priceline Europe and/or its third-party providers and distributors in accordance with the terms of and for the purposes set forth in the Privacy Policy. Priceline Europe makes no representation or warranty with regard to the sufficiency of the security measures used for data handling and storage. Priceline Europe will not be responsible for any actual or consequential damages that result from a lapse in compliance with the Privacy Policy because of a security breach or technical malfunction.
No Warranties
Unless a Provider has agreed otherwise, all products, services, advice, merchandise and information available through the NYOP areas of the Site are provided on an "as is", "as available" basis without warranties of any kind, either expressed or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any Request, (ii) that a User will receive the lowest available price for goods and/or services available through the NYOP areas of the Site, (iii) regarding the availability of products and/or services through the NYOP areas of the Site or, where applicable, at any participating retailer or retailer location, (iv) that use of the NYOP areas of the Site and all software, products or services associated with the NYOP areas of the Site will be error free, (v) regarding the results that may be obtained from the use of the NYOP areas of the Site, (vi) regarding the completeness, accuracy, reliability or quality of any information content, data, service, advice or merchandise provided or available through the NYOP areas of the Site, or (vii) regarding the performance or non-performance of the NYOP areas of the Site. You expressly agree that the use of the NYOP areas of the Site is at your sole risk.
General Limitation of Liability
IN NO EVENT SHALL PRICELINE EUROPE, INCLUDING ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND/OR AFFILIATES (COLLECTIVELY, THE "COVERED PARTIES"), BE LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, ACT OF GOD, ACCIDENT, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH ANY USE OF THE NYOP AREAS OF THE SITE OR WITH ANY DELAY OR INABILITY TO USE THE NYOP AREAS OF THE SITE, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS OR SERVICES OBTAINED THROUGH THE NYOP AREAS OF THE SITE, EVEN IF A COVERED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Further, the Covered Parties accept no responsibilities for any damage and/or delay due to Provider cancellations, shortages, sickness, pilferage, labor disputes, bankruptcy, machinery breakdown, quarantine, government restraints, weather, terrorism or causes beyond the Covered Parties' control. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority. No Covered Party shall be responsible for any Provider's breach of any warranty including, but not limited to, implied warranties of fitness for a particular purpose or of merchantability, nor shall any Covered Party be responsible for any other wrongdoing of a Provider (including any liability in tort), as to any products and/or services available through the NYOP areas of the Site. No Covered Party shall be responsible for any Provider's failure to comply with this Agreement nor for any Provider's failure to comply with applicable law.
If, notwithstanding the above, a Covered Party is found liable for any loss or damage relating to the use of the NYOP areas of the Site, User agrees the liability of any such party shall in no event exceed the total charge to the User assessed by Priceline Europe for making a Request. Some jurisdictions, to the extent their law might be deemed to apply notwithstanding the selection of law as described below, do not allow the limitation of liability, so the foregoing limitations might not apply to you.
Third Parties
If you use this Site to submit Requests for or on behalf of a third-party ("Third-party"), such as a family member or a traveling companion, you are responsible for any error in the accuracy of information provided in connection with such use. In addition, you must inform the Third-party of all Terms and Conditions applicable to all products or services acquired through this Site including all rules and restrictions applicable thereto. Each User using this Site for or on behalf of a Third-party agrees to indemnify and hold each Covered Party harmless from and against any and all liabilities, losses, damages, suits and claims (including the costs of defense), relating to the Third-party's or the User's failure to fulfill any of its obligations as described above. You are directly responsible for any Request submitted including for total charges and performance obligations.
User Comments, Feedback and Other Submissions
All comments, feedback, suggestions and ideas disclosed, submitted or offered to a Covered Party in connection with your use of the NYOP areas of the Site (collectively, "Comments"), shall be and remain the exclusive property of Priceline Europe and may be used by a Covered Party in any medium and for any purpose worldwide without obtaining your specific consent. For example, your Comments could be used on the NYOP areas of the Site and in radio, television and print advertisements. Your first name, first initial of your last name, and town and state/country may be used with any Comments you submit. No Covered Party is under any obligation to maintain your Comments (and the use of your first name and first initial of your last name with any comments) in confidence, to pay to you any compensation for any Comments submitted, or to respond to any of your Comments. You agree you will be solely responsible for the content of any Comments you make.
Response to Requests
While Priceline Europe will use its good faith efforts to respond to Requests within the time periods indicated on the NYOP areas of the Site, no guarantee is made that the status of your Request will be made available to you within the stated processing time. None of the Covered Parties is responsible for any errors or delays in responding to a Request including, without limitation, error or delays in responding to a Request caused by an incorrect e-mail address or other data provided by you or other technical problems beyond their control.
Links to Other Web Sites and Services
To the extent the NYOP areas of the Site contain links to outside services and resources, any concerns regarding such services or resources should be directed to the particular outside service or resource provider. None of the Covered Parties guarantees or warrants the accuracy or completeness of the information or content included on the Web sites of these outside services and resources.
Termination of Usage
User access to all or part of the NYOP areas of the Site may be terminated or suspended at any time, without notice and for any reason.
Debit or Credit Card Submissions
All Requests must be submitted with a major debit or credit card unless otherwise expressly stated.
Miscellaneous
The captions in this Agreement are only for convenience, and do not, in any way, limit or otherwise define the terms and provisions of this Agreement.
This Agreement and the related parts of this Agreement relating to each service represent the entire agreement between you and each Covered Party regarding your use of the NYOP areas of the Site and supersede any prior statements or representations. In the event that any provision of this Agreement is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions. The internal laws of the State of Delaware in the United States of America shall govern the performance of this Agreement.
PART II
Travel Services
A. General
Travel Service Limitation of Liability
THE HOTELS AND OTHER SUPPLIERS PROVIDING TRAVEL OR OTHER SERVICES THROUGH THE NYOP AREAS OF THE SITE (COLLECTIVELY, "TRAVEL SUPPLIERS") ARE INDEPENDENT CONTRACTORS AND NOT AGENTS OR EMPLOYEES OF THE COVERED PARTIES. THE COVERED PARTIES DO NOT ASSUME LIABILITY FOR ANY INJURY, DAMAGE, DEATH, LOSS, ACCIDENT OR DELAY DUE TO AN ACT OR OMMISSION OF A TRAVEL SUPPLIER, INCLUDING, WITHOUT LIMITATION, AN ACT OF NEGLIGENCE OR THE DEFAULT OF A TRAVEL SUPPLIER, OR AN ACT OF GOD. FURTHER, NO RESPONSIBILITIES ARE ACCEPTED FOR ANY DAMAGE AND/OR DELAY DUE TO SICKNESS, PILFERAGE, LABOR DISPUTES, BANKRUPTCY, MACHINERY BREAKDOWN, QUARANTINE, GOVERNMENT RESTRAINTS, WEATHER, TERRORISM OR CAUSES BEYOND THE COVERED PARTIES' CONTROL. NO RESPONSIBILITY IS ACCEPTED FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, FAILURE TO MAKE CONNECTIONS,RE-ROUTING OR ACTS OF ANY GOVERNMENTAL AUTHORITY.
B. Hotel Service Restrictions
General
Hotel room bookings made available through Priceline Europe's NYOP hotel service are subject to the disclosed terms and conditions of the applicable hotel.
The "Total Charges" that you will pay for using our hotel service will always be disclosed to you before you submit your Request.
Charges for Taxes and Service Fees. In connection with facilitating your NYOP hotel transaction, we will charge your debit or credit card for Taxes and for Service Fees. This charge includes an estimated amount to recover the amount we pay to the hotel in connection with your NYOP purchase for taxes owed by the hotel including, without limitation, sales and use tax, occupancy tax, room tax, excise tax, value added tax and/or other similar taxes. The amount paid to the hotel in connection with your NYOP hotel purchase for taxes may vary from the amount we estimate and include in the charge to you. The balance of the charge for Taxes and Service Fees is a fee we retain as part of the compensation for our services and to cover the costs of your NYOP hotel purchase, including, for example, customer service costs. The charge for Taxes and Service Fees varies based on a number of factors including, without limitation, the amount we pay the hotel and the location of the hotel where you will be staying.
We are not the vendor collecting and remitting taxes to the applicable taxing authorities. Our NYOP hotel suppliers, as vendors, bill all applicable taxes to us and we pay over such amounts directly to the vendors. We are not a co-vendor associated with the vendor with whom we book or reserve our customer's travel arrangements. Taxability and the appropriate tax rate and the type of applicable taxes vary greatly by location.
Depending on the city and property you stay in, you may also be charged resort fees or other incidental fees, such as parking charges. These charges, if applicable, will be payable by you to the hotel directly at checkout. When you check in, a credit card or, in the hotel's discretion, a debit card, will be required to secure these charges and any incidental fees (phone calls, room service, movie rentals, etc.) that you may incur during your stay.
Late Arrival and Failure to Check-in on First Night. If you are going to be delayed or find that you cannot check in to your NYOP hotel on the date you requested, you should contact the hotel to let them know. If you fail to check in to your hotel on the day of your reservation and do not alert the hotel, the remaining portion of your reservation will be canceled and you will not be entitled to a refund.
Special Needs. If you have special needs (e.g., wheelchair accessible room) you must call the hotel and verify that special needs can be met. Your hotel reservation will be refunded, canceled or modified if special handicapped needs cannot be met.
Must be 21 Years of Age. The guest on the reservation must be 21 years or older to check into the hotel.
Frequent Traveler Points. Frequent traveler points, upgrades, certificate vouchers and other discounts or incentives may not apply to Priceline Europe's NYOP hotel service.
Additional Restrictions. In addition to any restrictions described above, the following restrictions apply to Priceline Europe's NYOP hotel service:
i. All NYOP hotel reservations are non-cancelable, non-refundable, non-changeable and non-transferable by you. Once you purchase a reservation, your debit or credit card will be charged for the amount shown - regardless of whether or not the reservation is used. Credit will not be given for any unused reservations and cannot be used toward any future purchases;
ii. Once a NYOP Request is submitted, it cannot be modified by you; and
iii. Upon check-in, guests must present a valid ID and credit card or, in the hotel's discretion, debit card, in their name that is consistent with the transactional details provided to Priceline Europe (the amount of available credit required will vary by hotel). Debit cards may not be accepted.
We or the applicable hotel may, on an exception basis and at the request of the hotel guest, waive one or more of the restrictions after the NYOP hotel room has been booked. We may, in our discretion, impose additional obligations and/or fees in connection with any such waiver. No User waiver requests will be accepted or considered prior to or as part of a Request.
You agree that if a hotel room satisfying your NYOP Request is located, Priceline Europe will confirm the reservation and charge the entire amount of the stay, including applicable Taxes and Service Fees (as described above) disclosed to you before submitting the offer, to your debit or credit card. The price you name is per night and does not include Priceline Europe's charge to you for Taxes and Service Fees.
Hotel Accommodations and Special Requests. All NYOP hotel reservations are guaranteed for double occupancy (one double bed or two twin beds). Priceline Europe requests that our NYOP hotel suppliers provide non-smoking rooms. However room assignments are based on hotel availability and are at the hotel's discretion. We cannot guarantee a non-smoking room, nor can we guarantee you will have one bed or two. If you have special requests (such as smoking room, pet accommodations, type of bedding, connecting rooms, view, floor location, etc.), you must call the hotel and verify that special requests can be met after your reservation is confirmed. Priceline Europe makes no guarantee that special requests will be met. A NYOP hotel reservation cannot be refunded, canceled or modified on the basis that a special request was not (or could not be) met by the hotel.
Hotel Star Ratings. Priceline Europe will book your NYOP reservation in a property with an equal or higher star level than you requested.
Median Retail Price. The "median retail price" which we may display to you is the median of the lowest rates our participating NYOP hotels are offering to the general public for the travel dates you selected based on information our NYOP hotel suppliers have loaded into our global distribution system. These rates are based on the quality level you chose, the city, and the area you selected. These rates are recorded at the time of booking and do not include rates that are restricted to membership programs (such as AAA, AARP, etc.), Government rates, negotiated corporate rates, etc. Although we routinely review this data, we make no guarantee or warranty, either express or implied, with respect to the accuracy or completeness of the data used or provided. Further, we make no guarantee or warranty that a room will be available below or within the disclosed price range. The ranges are provided to you solely for information purposes and are not actual rates. All hotel pricing information available on the NYOP areas of the Site is subject to change without notice.
